Is a Licence Required for CO2 Guns in India? Arms Act & Rules 2016 Explained

The short answer: most CO2 pistols do not require an arms licence in India. But the full picture is more nuanced — here is exactly what the law says, what the thresholds are, and what you need to buy from us.

Disclaimer: This is general information based on the Arms Rules 2016 and is not legal advice. Always verify current regulations with a licensed legal professional or local authorities before purchase.

The Core Legal Framework

In India, air weapons are regulated under the Arms Act 1959 and Arms Rules 2016. The key distinction — whether you need a licence — depends on two measurable thresholds:

  • Muzzle Energy: Under 20 Joules
  • Bore Size: Under 4.5mm (.177 calibre)

An air weapon that satisfies both conditions is classified as a sub-threshold air weapon and does not require an arms licence under the Arms Rules 2016.

What Does "Below 20 Joules" Mean in Practice?

Most CO2 pistols sold at Sahibzada Gun House are in the 3–7 joule range — well below the 20-joule threshold. For context, 20 joules translates to roughly 820 FPS with a standard 0.53g pellet. The vast majority of sub-20-joule CO2 guns fire at 300–500 FPS.

Weapons That DO Require a Licence

An air weapon requires full arms licence compliance if it:

  • Exceeds 20 joules of muzzle energy, OR
  • Has a bore greater than 4.5mm (e.g., .22 or .25 calibre above the energy threshold)

These are treated the same as conventional firearms and require a valid Arms Licence (AL) issued by district authorities.

Do CO2 Cartridges, Pellets, or BBs Require a Licence?

No. CO2 cartridges (12g, 88g), lead pellets, and steel BBs are not classified as arms or ammunition under the Arms Act. They can be purchased freely by any adult. No licence is required to own, transport, or use these consumables.

What Sahibzada Gun House Requires

Even for sub-threshold, licence-free air weapons, we have implemented the following compliance process to protect both our customers and our business:

  • Aadhaar Verification: Both sides of Aadhaar card must be uploaded at checkout. This confirms identity and minimum age (18+).
  • Contact Details: Name, phone number, and delivery address are retained for compliance records.
  • Data Handling: All Aadhaar data is stored encrypted and deleted after order fulfilment in line with UIDAI guidelines.

For weapons above the threshold, a copy of your valid Arms Licence must be submitted and verified before dispatch.

Frequently Asked Questions

Do I need a licence to buy a CO2 pistol in India?

No, if the pistol is below 20 joules and .177 calibre. Most of our CO2 pistols fall well under this threshold.

Can I carry a CO2 pistol in public?

No. Even for sub-threshold air weapons, carrying in a public place without lawful authority may attract charges under Section 4 of the Arms Act. Always store and transport your airgun in a secure case.

What if I live in Jammu & Kashmir or other states with stricter rules?

Some states and Union Territories may have additional local restrictions. Please verify with your local district arms authority before purchasing.
